Racing a bike takes a lot more balls than racing a car, that's for sure.

I've got a set of stock rims in great condition, off an '89 FZR1000.

Far out Kiwi, glad you're (relatively) ok, sorry to hear about the bangup,

No such luck cam, my estimate is running at $3K, including a new helmet.

So what's the damage break down Kiwi? Obviously more than a couple of rims?

I'm with Jason in that I would be looking at the track management for reinbursment of some sort. You should be able to safely run up onto a ripple strip... That's what they are for.

Lower fairing plastic welding $100
Screen$120
Paint $500
Helmet (Aria or similar quality) $700 - $1000
Incidentals that I don't know about yet????

Unfortunatley, the fine print in the entry form clearly states that if shit happens - it ain't no ones fault but mine - no matter what, and I accept that, after all, I was the one pointing the bike eh.

1. I have read the Supplementary Regulations for this competition and agree to be bound by them and the General Rules of
Motorcycling NZ Inc.
2. I am aware that the sport of Motorcycle Competition might:
a. Cause me injury, serious or otherwise.
b. Damage my property.
3. I wish to take part in this competition despite the above risks.
4. Neither I, nor anyone associated or connected with me, will make any claim against you or your officers, employees or
agents in respect of:
a. Any injury suffered by me; or
b. Any damage to any of my property
regardless of how the injury or damage occurs.
5. I will indemnify you against all claims, damages or losses (including costs), which you incur as the direct or indirect result of
any injury to me or damage, to my property.


These rules are from the club who ran the race meeting (and standard form here in NZ), and as they are the ones who have hired the track, then I have no claim against them or the track owners.
Besides, the amount of bad vibes that trying to make a claim would cause; would probably burn a lot of bridges that I want to remain intact.

At the end of the day, shit just happens somedays eh :)

You (and others) should be aware that putting this wording in
the contract does not allow them to be negligent in safety.
If the law is anything like Australia you would still be entitled to take action,
because the law requires them to maintain a safe (as far as reasonably
possible) environment regardless of them saying so.

As an extreme example, if you borrowed money and signed a contract
saying they could break your legs if you didn't pay back on time,
they would still not be allowed to break your legs.

However, I can totally sympathise with you not wanting to blame them
for it, and yes there are far too few people in this world willing to be
responsible for their own risks and actions. I don't know the
circumstances but it sounds like you have made a sensible decision
and I would probably decide the same if I were in your shoes.

lol... here we go...Waivers will not stand up as a defense against negligence, especially that of which was, or is evidently obvious. Clerk of course should either carry out a track inspection or have one carried out. Whoever is responsible for the facility and the event should ensure it is fit for purpose. Waivers aren't worth the paper they a written on unless those offering service have done everything to ensure the safety of the participants. I'm sure the law isn't that much different to here over your side of the ditch

Let's face it Kiwi, you're lucky to be alive. I understand the need not to rock the boat, however, your club, yourself, and anyone who participates in racing has a responsibility, to ensure safety for themselves and other participants. Next time there is a meeting such obvious hazards should be absent. You are paying customers as well.

If it wasn't for the likes of Kenny Roberts, a riders safety advocate, the blokes engaging in professional racing would still be viewed as the monkeys who ride the bikes, paid peanuts, and dispensable...

At least I would be asking that for future events the course is fit for purpose...lol... just my :2cents
